Please read these Terms of Service ("Terms") carefully before placing an order or using our website at ponponsnacks.com (the "Site"). By accessing the Site or purchasing our products, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Who We Are

Pon Pon LLC, doing business as Pon Pon Snacks (“we,” “us,” or “our”) is a food brand based in California, selling cream-coated protein biscuit sticks and related products.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract in your jurisdiction to purchase from our Site. By placing an order, you represent that you meet these requirements. If you are purchasing on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

3. Products

We sell cream-coated protein biscuit sticks in a variety of flavors. Product descriptions, images, and nutritional information on our Site are as accurate as possible. Minor variations in color, appearance, or flavor may occur between product batches.

We reserve the right to discontinue, modify, or reformulate products at any time. All products are intended for personal consumption only and may not be resold without our prior written permission.

4. Preorders

We are currently accepting preorders. By placing a preorder, you acknowledge and agree to the following:

  • Your payment will be charged at the time your order is placed, not at the time of shipment.
  • The estimated ship date for current preorders is mid-June 2026. This date is an estimate and is subject to change due to manufacturing timelines, shipping logistics, customs clearance, or other factors outside our control.
  • If the expected ship date changes significantly, we will notify you by email with an updated estimate and give you the option to cancel your order for a full refund.
  • If we are unable to fulfill your preorder for any reason, you will receive a full refund.
  • Preorder bonus offers (such as free bonus boxes) are valid only at the time of the preorder and are subject to availability.
  • Order modifications or cancellations may be requested within 24 hours of placing your order by contacting us at hello@ponponsnacks.com. After 24 hours, we cannot guarantee that changes can be made before the order is processed.

5. Pricing and Payment

All prices on our Site are listed in US dollars and do not include applicable taxes or shipping fees unless stated at checkout. We reserve the right to change prices at any time. The price displayed at checkout is the price you will be charged.

Payments are processed securely by Shopify Payments. We accept major credit and debit cards. We do not store your full payment card details on our servers. By submitting your payment information, you represent that you are authorized to use the payment method provided and that the information is accurate.

If your payment is declined or a chargeback is filed, we reserve the right to cancel your order and, if applicable, take appropriate action to recover costs.

6. Shipping and Delivery

We ship within the United States and internationally. Shipping costs and estimated delivery windows are calculated and displayed at checkout. Delivery estimates are not guaranteed and may vary due to carrier delays, weather, or customs processing.

Domestic Shipping

Orders shipped within the United States are subject to applicable state and local sales tax. Shipping costs are calculated based on your location and order weight.

International Shipping

For orders shipped outside the United States:

  • You are responsible for all import duties, customs fees, taxes, and other charges imposed by your country's customs authorities. These charges are not included in our product prices or shipping fees.
  • We are not responsible for delays caused by customs processing or local delivery infrastructure.
  • If a package is refused at customs or returned to us due to unpaid duties or failure to claim, we may not be able to refund shipping costs. We will contact you to discuss options.
  • Some countries have import restrictions on food products. It is your responsibility to ensure that importing our products is permitted in your country.

Risk of loss and title for products pass to you upon our delivery of the order to the carrier. We are not responsible for lost or stolen packages once they have been marked as delivered by the carrier. If your package is lost in transit before delivery, please contact us and we will work with the carrier to investigate.

7. Returns and Refunds

Because our products are perishable food items, we do not accept returns of opened or partially consumed products, or returns based on a change of mind after products have shipped.

If you receive a damaged, defective, or incorrect item, please contact us at hello@ponponsnacks.com within 7 days of the delivery date. Include your order number and photos of the issue. We will work with you to make it right, either by sending a replacement or issuing a refund or store credit.

For preorders: if we cancel a preorder, you will receive a full refund to your original payment method within 5 to 10 business days.

8. Food Allergen and Nutritional Disclaimer

Our products contain wheat, milk, and soy. They are not gluten-free and are not suitable for vegans. Our products are manufactured in a facility that also processes other allergens, which may include tree nuts, peanuts, and sesame.

If you have food allergies, intolerances, or dietary restrictions, please carefully review the full ingredient list and allergen information on the product packaging before consuming. We are not responsible for adverse reactions resulting from failure to review allergen information.

Our products are food and snack items. They are not intended to diagnose, treat, cure, or prevent any disease or health condition. Any nutritional or functional claims on our packaging or website have not been evaluated by the U.S. Food and Drug Administration (FDA).

9. Intellectual Property

All content on our Site, including but not limited to text, product descriptions, images, photographs, logos, brand names, packaging designs, and graphics, is owned by or licensed to Pon Pon LLC and is protected by applicable copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, display, perform, or create derivative works from any content on our Site without our prior written permission. Unauthorized use of our intellectual property may result in legal action.

10. Prohibited Uses

You agree not to use our Site or services to:

  • Violate any applicable local, state, national, or international law or regulation
  • Impersonate any person or entity, or falsely claim an affiliation
  • Engage in fraudulent activity, including submitting false order information or chargebacks without a valid basis
  • Attempt to gain unauthorized access to any part of our Site or systems
  • Interfere with the security, functionality, or performance of our Site
  • Scrape, harvest, or collect data from our Site without our express written permission
  • Use our Site for any commercial purpose without our prior written consent

11. Disclaimer of Warranties

Our Site and products are provided "as is" and "as available" without warranties of any kind, either express or implied, to the fullest extent permitted by applicable law. We do not warrant that our Site will be error-free, uninterrupted, secure, or free of viruses or other harmful components.

Some jurisdictions do not allow the exclusion of implied warranties. In those jurisdictions, the above exclusions may not fully apply to you.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Pon Pon LLC and its officers, directors, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, loss of goodwill, or personal injury, arising out of or in connection with your use of our Site or purchase of our products.

Our total liability to you for any claim arising from these Terms or your use of our Site will not exceed the total amount you paid to us for the product or service giving rise to the claim in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. If you are in such a jurisdiction, some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Pon Pon LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of our Site, your violation of these Terms, or your violation of any third-party rights.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Informal Resolution

Before initiating any formal dispute, you agree to contact us at hello@ponponsnacks.com and give us an opportunity to resolve the issue informally within 30 days.

Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of our Site (except claims brought in small claims court) will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver

You and Pon Pon LLC each waive the right to bring or participate in any class action, collective action, or representative proceeding. All disputes must be resolved on an individual basis.

Exceptions

Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction for claims involving intellectual property rights or unauthorized access to our systems.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements or policies referenced herein, constitute the entire agreement between you and Pon Pon LLC regarding your use of our Site and purchase of our products. They supersede all prior or contemporaneous agreements, representations, or understandings, whether written or oral.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated Terms on this page and update the "Last Updated" date. If we make material changes, we may notify you by email. Your continued use of our Site after the updated Terms are posted constitutes your acceptance of those changes.
